Jerusalem - The military prosecution decided on Tuesday to charge a Palestinian suspect in the killing of an Israeli man with manslaughter rather than murder, claiming they could not prove the attack was premeditated.
The decision came six months after the October truck-ramming attack in Al-Fawwar junction that killed 54-year-old Avraham Hasno of Kiryat Arba. Behind the wheel was Sahban Wael a-Titi, 27, a resident of Hebron.
Hasno’s family voiced their outrage at the decision to Israel’s Army Radio on Wednesday morning.
“The attack was premeditated, this terrorist came with the goal of killing Avraham,” said Ruti Hasno, the victim’s wife. “They placed a roadblock with wooden planks and nails so Avraham couldn’t pass. He tried to stop and escape to the side but he had no option, he was pelted with stones. Everything he did was filmed, he had to defend himself and all he had was the wooden club. Unfortunately, it all went according to their plan.”
“We have been in a storm of emotions since they announced it,” said Hasno’s daughter Natalie. “It threw us back to the day of his murder. My dad was surrounded and had no way to escape. The murderer was not satisfied with running him over only once – he ran him over for a second and third time, dragged him for 37 meters, escaped, and left him like that.”
“Today we start mourning Avraham again,” said Meydad Hasno, the victim’s son. “My father was murdered in cold blood and we are told this is manslaughter and not murder. We are angry and disappointed.”
Avraham Asher Hasno, 54, was killed in a truck-ramming attack in Al-Fawwar junction in the Mount Hebron region on October 20, 2015. An ambush was apparently set up on the road and rocks were thrown at his car. He then got out of the car with a wooden club in his hand, only to be rammed by a truck and left to die.
Sahban Wael a-Titi, the fleeing driver, soon turned himself in to the Palestinian police and claimed it had been an accident. He was arrested by the Israel Security Agency (Shin Bet) in March.
After finding insufficient evidence that the attack was premeditated, the military prosecution indicted a-Titi on charges of manslaughter and of abandoning Hasno after hitting him.
According to the indictment, filed at the military court in Judea, the Palestinian “noticed Avraham Hasno closing in on the truck he was driving. The deceased stopped in front of the truck. The defendant then accelerated towards the deceased, hit him, continued driving and dragged the deceased for about 37 meters, before he fled the scene.”
“This decision is destructive and is a disaster for the family, for Kiryat Arba residents, and for all of Israel,” commented the family’s attorney, Ofir Sabag. “Settlers’ blood is just as red as any citizen’s. We will not let cowards cheapen our blood just so we look good in the world. We will consult will legal teams and plan our next steps.”
“I want to tell all Israelis: My husband was murdered on October 20, and yesterday he was murdered again,” concluded Ruti Hasno.
