A big blow to President Joe Biden's green energy agenda after a federal appeals court ruled the federal government cannot dictate what kind of washing machine or dishwasher you use.

President of Americans for Tax Reform Grover Norquist joined The National Desk’s Jan Jeffcoat to discuss the issue.

“What's happened is during the Trump administration, they looked at some of these regulations and said, Do they make any sense? Is it any of the federal government's business? and they stepped back and said, The American people can decide what kind of dishwashers they want,” he said. “You can use less water, but it can take you several hours to wash dishes or your clothes. You might prefer to be able to do things more quickly and under your control.”

Dozens of states were sued after the administration's regulatory actions targeted home appliances. In its ruling, the Fifth Circuit of Appeals stated, “Assuming both energy conservation metrics are on the table, the States argue, and D.O.E. does not appear to dispute that one important aspect of that problem is whether appliance regulations actually reduce energy and water consumption. Yet the administrative record contains ample evidence that D.O.E.’s efficiency standards likely do the opposite: They make Americans use more energy and more water for the simple reason that reportedly ‘energy-efficient’ appliances do not work....
