How Long Might Marilyn Mosby Serve in Prison?

It was just last week a federal jury found former Baltimore City State’s Attorney Marilyn Mosby guilty of two counts of perjury.

Now, she’s set to be back in court on January 18, facing two counts of making false statements on mortgage applications related to the purchases of two vacation homes in Florida.

“It’s a very strong case. She’s an attorney. She signed her name a bunch of times to a bunch of legal documents. It’s literally what we’re supposed to do for a living as lawyers,” said Kurt Nachtman of EN Lawyers.

Once that trial comes to an end, Mosby will be sentenced for the two perjury counts, each carrying a maximum sentence of five years.

If found guilty, the mortgage fraud counts each carry a maximum sentence of 30 years in federal prison.

“She’s subject to the maximum penalty to each of the counts she’s facing assuming she’s convicted of all of them,” Nachtman said.

Nachtman, who’s not associated with the case, says it’s unlikely she’d get the maximum sentence and spend seven decades behind bars.

He says it's more likely the perjury counts will carry a sentence of anywhere between 15-21 months each.

Either way, he believes she’ll still likely spend years in federal prison.

“Assuming that Mosby is convicted of all of her conduct I believe she will serve more than 12 months, more than 24 months in federal prison,” he said.

Nachtman says a plea negotiation could also still be on the table, and that could mean a more lenient sentence.

“The government may or may not want to do that. Ultimately, it’s going to be Erik Barron's decision as to whether they’re going to engage in a discussion,” he said.
