Baltimore, MD - Nov. 9, 2023 - UPDATE: Marilyn Mosby's perjury case is now in the hands of the jury. Deliberations are set to begin this morning.
During closing statements, Assistant US Attorney Aaron Zelinsky told jurors that, even though former Baltimore City State's Attorney Marilyn Mosby made almost a quarter of a million dollars, she wanted more money to purchase two vacation homes in Florida.
Zelinsky said while there were no restrictions on what Mosby could do with the money, what she spent it on "tells you a lot."
"We should not allow her to lie and commit perjury to purchase $1 million worth of vacation homes in Florida," said Zelinsky.
"This case is about a 3-page form and what was in Marilyn Mosby’s mind when she filled it out," said Federal Public Defender James Wyda during his closing argument.
Wyda said Mosby believed she qualified.
"The government is wrong," said Wyda.
Wyda said Mosby sunk money into her launching her business and she lost out on future profits because of the pandemic.
"You know the world stopped when the pandemic hit," Wyda said. "For Ms. Mosby, the pandemic meant the crashing of her dream."
"The evidence is that Marilyn Mosby got it right. But even if she didn’t, if you think she got it wrong, it’s not a crime. It’s a mistake," said Wyda. "She reasonably thought she faced an adverse financial consequence. Marilyn Mosby is innocent."
Wyda did use the phrase “her money” during closing arguments, which was not supposed to be used during the trial. Judge Lydia Kay Griggsby told the jury that the term would be stricken from the record.
