According to a Batei Din registry report released on Tuesday 26 Sivan pertaining to divorce in Israel in 2016, Jerusalem leads the nation.

The report documents an increase in divorce in Israel of 1.8% in 2016 as compared to the previous year with a total of 10,841 couples as compared to 10,653 in 2015.

Tel Aviv is in second place in 2016, recording 701 divorces and Rishon L’Tzion third, with 441. The list continues in order with Haifa, Petach Tikvah, Beersheva, Netanya, Ashdod, Holon and Ramat Gan.

If one takes a look at chareidi communities one finds there were 165 divorces in Bnei Brak as compared to 149 in 2015, representing an 11% increase. There was a 13% decline in Elad with 49 divorces in 2016 as compared to 56 in 2015. However, the trend is reversed in Modi’in Illit with an increase of 45%, with 42 divorces in 2016 as compared to 29 in 2015. In Betar Illit there was a decline as well B”H, 7% fewer divorces in 2016 during which there were 38 as compared to 41 in 2015.

In 2016, there were a total of 2,976 divorces in the Tel Aviv Region Beis Din, 1,764 in the Haifa Region and 1,461 in Yerushalayim. The data adds that in 58% of cases, the divorce process began with consent between spouses while 42% the couple was in conflict.

We also learn that in Ramat HaSharon, Givatayim, Beit Shemesh, Gadera, Ohr Yehuda, Modi’in Illit, and Zichron Yaakov there was a significant increase in the number of divorce.

Chatzor HaGlilit and Tel Monde each register 22 divorces.

In the past year, 5,308 cases have been opened for divorce cases in addition to 9,811 cases for divorce agreements. These are added to 3,545 cases for settling disputes according to the temporary order established in the law that an effort towards shalom bayis must be made with the assistance of the Welfare Ministry unit attached to the batei din.

בשנה האחרונה נפתחו 5,308 תיקים לתביעות גירושין בנוסף ל-9,811 תיקים להסכמי גירושין, אלה מתווספים ל-3,545 תיקים ליישוב סכסוך על פי הוראת השעה שנקבעה בחוק במסגרתה יש להקדים ניסיון ליישוב הסכסוך על ידי יחידות הסיוע של משרד הרווחה שליד בתי הדין.

היחידה המיוחדת של הנהלת בתי הדין בנושא התרת עגונות הצליחה להשיג בשנת 2016 גט ל-211 נשים שבעליהן נעלמו בארץ ובחו”ל, לעומת 180 אשתקד. מדובר בעליה של 17%, כאשר מונו 7 חברות חקירה פרטיות לאיתור סרבני גט בארץ ובחו”ל.

בנושא סרבנות הגט ניתנו 205 החלטות לסנקציות, מתוכם 165 נגד גברים ו-40 נגד נשים – עבור 36 סרבני גט ו-11 סרבניות גט. הסנקציות כוללות צו עיכוב יציאה מהארץ, מניעת ניהול חשבון בנק, מניעת רישיון נהיגה, מניעת מינוי למשרה ציבורית, מניעת תנאים מאסירים פליליים שהם גם סרבני גט ועוד.

בשנה זו הוכרעו בבג”ץ 41 עתירות שהוגשו נגד בתי הדין, כאשר שום עתירה לא התקבלה.

עוד עולה מהדו”ח שמפרסמת הנהלת בתי הדין הרבניים כי בשנת 2016 נפתחו 88,997 תיקים ונסגרו 90,938 – כלומר קצב הטיפול במלאי התיקים עומד על 102%. קצב הטיפול במלאי התיקים מחושב על ידי חלוקת מספר התיקים שנסגרו במספר התיקים שנפתחו.

מנהל בתי הדין הרבניים הרב שמעון יעקבי ציין כי “בתי הדין הרבניים מתייעלים ועובדים במלוא כוח התפוקה האפשרי. בשנה הקרובה נפעל לשדרוג מערכת המחשוב של בתי הדין ולהוספת דרכי תקשורת אלקטרוניים שייקלו ככל האפשר על בעלי הדין ועל עורכי הדין והטוענים הרבניים להגיש תביעות ובקשות בלא צורך להגיע באופן פיזי למזכירויות בתי הדין. כמו כן נפעל לביצוע יעיל ומהיר ככל האפשר של פסקי דין לגירושין”.
